FED:Clyde Holding: Labor's nearly man

CANBERRA, Aug 1 AAP - Clyde Holding was one of Labor's nearly men.
He led the party in Victoria for 10 turbulent years without becoming premier and was
a federal minister in Bob Hawke's government for seven.
But he was only briefly in cabinet and eventually lost the support of Hawke, with whom
he'd been close.
Allan Clyde Holding, who died on Monday aged 80, was born in Melbourne on April 27 1931.
He graduated in law from the University of Melbourne and became a prominent practitioner
in industrial law.
Holding joined the ALP as a student and, like many Victorian Labor figures of his time,
cut his political teeth in the campaign against the death penalty.
He was elected to the Victorian parliament in 1962 for the seat of Richmond. In 1967,
after Labor suffered its fourth straight defeat, and although a member of the right, he
replaced Clive Stoneham as leader.
The 1972 election, against the ageing Henry Bolte, looked winnable.
But his chances were destroyed by the dominant left. After a blazing row with state
secretary Bill Hartley, he was forced to repudiate state aid for non-government schools.
A furious Gough Whitlam refused to campaign and Bolte, exploiting Labor's disarray, waltzed back.
The episode led to federal intervention, with the left leadership thrown out and allies
of Whitlam, Hawke, then ACTU president, and Holding installed - the last essential structural
change before the 1972 federal election which brought Whitlam to power.
But with faction fighting continuing as the left re-formed into the Socialist Left,
the Whitlam surge was not reflected in Victorian state politics.
Holding easily saw off a leadership challenge from Barry Jones with the remark "Quiz
kids can't count".
But he lost twice to Bolte's successor, Dick Hamer, in 1973 and 1976.
After the second loss, he resigned the leadership and the following year was elected
to federal parliament for the seat of Melbourne Ports - after beating Simon Crean, son
of the the retiring member and former Whitlam treasurer Frank Crean, for preselection.
When Hawke entered parliament in 1980 and started stalking the leadership, Holding
was an important ally.
And when Hawke won in 1983, the new prime minister ensured Holding was elected to the
ministry and made him Aboriginal affairs minister, a non-cabinet post.
Holding wanted to bring in uniform national Aboriginal land rights, and thought Hawke
would support him.
But Hawke, after being lobbied ferociously by mining interests and Western Australian
premier Brian Burke, dropped the proposal.
Holding held several minor portfolios until, in 1988, he was given the cabinet position
of immigration and ethnic affairs.
But later that year, as part of a wider reshuffle, Hawke demoted him to arts and territories.
It was a messy, widely leaked and never fully explained blow that Holding tried to resist.
Some thought Holding hadn't attacked John Howard aggressively enough after the opposition
leader's controversial questioning of Asian immigration.
Hawke's version was that Holding wanted to quit the ministry in 1990, although Holding
maintained that the prime minister knew this before giving him immigration.
He went to the backbench in 1990, where he stayed until his retirement in 1998.
Holding was a competent and conscientious administrator with limited persuasive skills,
and a sometimes abrasive factional warrior.
An Aboriginal commentator, writing on land rights, dismissed him as "an old style,
cynical Labor numbers man".
On the other hand, Hawke's acerbic finance minister Peter Walsh thought Holding was
far too ready to believe Aboriginal lobbyists, however dodgy their evidence.
A later Labor Aboriginal affairs minister, Robert Tickner, was probably fairest about
how Holding handled the difficult job: "Ultimately, he was like all Aboriginal affairs
ministers thus far, a non-cabinet minister ... invited into the inner sanctum of cabinet
only for Aboriginal affairs issues where he would have been hopelessly outnumbered by
the economic rationalists who had very little empathy with Aboriginal aspirations."
He was, perhaps, a cynic with decency.
John Button went to his first Labor state conference as an outspoken young reformist
and was booed and hissed for his dissident speeches.
Holding took him aside for counselling.
"I know," Holding told him, "that you believe all that stuff about integrity in politics
... but that's not the way it works."
Button concluded: "He was a friendly man and meant well."
Holding married twice - first to Margaret Sheer, with whom he had two sons and a daughter;
and to Judith Crump, with whom he had a daughter.

FED:No parole for man convicted of cop death
SYDNEY, April 5 AAP - One of four men jailed over the shooting murder of a Sydney police
officer nine years ago has been refused parole by the State Parole Authority (SPA) until
he undertakes further rehabilitation.
The SPA said on Tuesday it had refused parole to Meli Lagi, one of four men convicted
over the murder of Senior Constable Glenn McEnally in Sydney in 2002.
"The State Parole Authority, in a meeting on March 4, 2011, decided to refuse parole
for Lagi until he undertakes further rehabilitation programs in prison aimed at addressing
violent behaviour," it said in a statement.
The decision was confirmed at a public hearing on Tuesday.
Constable McEnally, 26, was shot four times in the chest and head after he pursued
a stolen car at Hillsdale, in Sydney's southeast, in March 2002.
He died of his wounds in hospital a week later.
Lagi was acquitted of murdering Constable McEnally but was sentenced to almost 13 years
for firearms offences, with a non-parole period of almost nine years.
The earliest possible release date for Lagi was April 2, 2011, and he will again be
considered for parole in February 2012.
Co-offender Sione Penisini, serving a total sentence of 36 years, is eligible for parole
in 2029, the SPA said.
Brothers John and Motekiai Taufahema are serving a 14-year and 11-year sentences, respectively,
for their involvement in the murder, with both becoming eligible for parole in 2012.

FED:NZ won't join anti-whaling court case: Rudd
Australia says New Zealand's decision not to join an international court case against
Japanese whaling is a tactical move .. which will help end the so-called scientific whaling
program.
Australia launched proceedings against Japan in the International Court of Justice in May.
Foreign Minister KEVIN RUDD has now announced New Zealand won't file as a party to
that action .. but will instead intervene in the case.
He says this will enable New Zealand to make both written and oral submissions to the
court that Japanese whaling in the Southern Ocean is contrary to its obligations under
international conventions.
A decision by the ICJ isn't is expected until at least 2013.

VIC:Plane crash-lands in backyard
Paramedics at the scene say it was miraculous that the pilot and passenger were able
to walk away from the crash.
"The plane has clipped the roof of one house and landed in the backyard of an adjoining
house," said Ray Rowe of Ambulance Victoria.
"It was a miraculous escape - (the pilot and passenger) were shaken from the experience
but not injured," he said.
The plane was coming in to land and just fell short of the runway at Moorabbin Airport.
Victoria Police spokesman Wayne Wilson said the plane is a write-off.
"It will never fly again," he told AAP.
"It's ended up against a wall and in between the house and a swimming pool.
"It's badly damaged yet the house has just lost a few tiles from the top of the roof."

CANBERRA, April 6 AAP - Australia is urging a "robust" response from the United Nations
Security Council to North Korea's rogue launch of a long-range missile.
The Security Council is at a stalemate after hours of talks on how to deal with Pyongyang's
launch on Sunday of a three-stage Taepodong-2 missile, which some believe could potentially
reach northern Australia with its estimated range of 6,700 kilometres.
Australia has joined the United States and Japan in describing the North Korean move
as a provocative act in breach of UN resolutions.
Foreign Minister Stephen Smith reiterated Australia's condemnation of Pyongyang's rocket launch.
"It was a provocative act that was in breach of UN Security Council Resolution 1718,"
a spokeswoman for the minister said.
"Australia urges the UN Security Council to respond robustly to the launch.
"Australia is consulting closely with other countries, including the United States,
Japan and the ROK (South Korea), on the international community's response to the launch."
Opposition foreign affairs spokeswoman Julie Bishop warned the launch had the potential
to destabilise the region.
"The launch has the potential to destabilise the region and undermines recent international
negotiations with the North Korean regime," she said in a statement.
"The Australian government must work with the international community to continue to
pressure the regime into abandoning its missile development and nuclear weapons programs.
"Three of Australia's most important trading and strategic partners are in the region
and it is vital for Australia that stability is maintained."
Neighbouring South Korea and Japan have signalled a strong response to the North Korean action.
Seoul has vowed a "stern response" and Japan has threatened new sanctions.

Fed: RAAF chief says it won't get better than JSF

CANBERRA, Dec 2 AAP - The new Joint Strike Fighter (JSF) will be the best multi-role
combat aircraft in the world, fitted with the best equipment and flown by the best people,
RAAF chief Air Marshal Mark Binskin says.
In a no-holds barred endorsement of the controversial aircraft, Air Marshal Binskin
said Australia would need about 100 to maintain a credible level of air combat capability.
He said new Russian-built fighters entering service across the region were decent aircraft
and could be part of a decent air combat system, depending on what extra equipment they
were plugged into.
But at the end of the day, JSF would be much better, he said.
"We are looking at what will be the best multi-role aircraft in the world," he told
an Australian Strategic Policy Institute function.
"It will have the best radar, the best defensive system of any of those aircraft in the world.
"It will be supported by the best airborne early warning and control aircraft and the
best tanker in the world and flown, maintained and supported by the best people in the
world."
"I've got to tell you - the system ain't going to get any better than that."
The JSF is set to replace ageing F/A-18 Hornets and F-111 bombers, entering service
with the RAAF around the middle of next decade.
However, the government has yet to commit to buying the aircraft. That will likely
occur around June next year.
The JSF remains in development with only two aircraft having flown. The project has
been strongly criticised over possible cost blowouts, delays and technical shortcomings.
Air Marshal Binskin said all modelling of future air combat needs indicated Australia
should acquire around 100 of the new aircraft.
"No matter how you model it, the modelling keeps coming back to 100," he said.
Air Marshal Binskin said the RAAF was now in a position where 73 per cent of its aircraft
were in the final 10 years of their life.
Only the four new C-17 transport aircraft are at the start of their service life.
Set to enter service in the next decade are 24 Boeing Super Hornets, six Wedgetail
airborne early warning aircraft, five Airbus tankers and an unspecified number of new
maritime surveillance aircraft.
He said the RAAF had already started the process of retiring the F-111 strike bombers.

NSW: Jackie Kelly's husband pleads not guilty over poll leaflets
SYDNEY, April 29 AAP - The husband of former federal Liberal minister Jackie Kelly
has pleaded not guilty over his alleged role in distributing bogus leaflets during last
year's federal election campaign.
Gary James Clark appeared briefly today in Sydney's Downing Centre Local Court over
the leaflet scandal, which erupted days before the election last November.
Clark was one of five men charged under the Commonwealth Electoral Act over the distribution
of pamphlets which allegedly portrayed the Labor party as being aligned with a radical
Islamic element in the key western Sydney seat of Lindsay, formerly held by Ms Kelly.
The husband of unsuccessful Liberal candidate Karen Chijoff, who had replaced Ms Kelly
as the party's candidate, was also charged over the scam, which was allegedly uncovered
in a Labor Party sting.
Appearing before Magistrate Pat O'Shane, Clark's lawyer Oliver Hagen today entered
a plea of not guilty on his client's behalf.
Bruce Levet, barrister for NSW Liberals right faction powerbroker Jeff Egan, also entered
a not guilty plea for his client over the allegations.
Dressed in a dark suit and blue and white striped tie, Egan smiled politely as he stood
at the rear of the court.
Outside court, Mr Levet said Egan would vigorously defend the charges.
"He wants to clear his name and do so as quickly as possible," Mr Levet told reporters.
"In the circumstances it is not appropriate for him to comment further at this time."
Ms Chijoff's husband Greg Chijoff, co-accused Troy Craig and one other person, as yet
unnamed, were expected to appear in court later today.
Chijoff and Egan were ousted from the Liberal Party after the controversy over the
leaflets, but Egan was permitted to return in February this year.
Clark was not a member of the Liberal Party.

HOBART, Dec 26 AAP - An inmate who escaped on Christmas Day from Hayes Prison Farm
in Tasmania's south has been found.
Tasmanian Police said Robert Alan Derks was found by correctional services staff about
6.30am (AEDT) today at New Norfolk, about 3km from the prison.
Derks, 19, who escaped the minimum security prison farm between 8pm (AEDT) and 9pm
yesterday, was serving a prison term for burglary, stealing and traffic matters.
Police had no further details about the circumstances in which Derks was found.

Fed: New penalties for employing workers without a valid visa
CANBERRA, Aug 18 AAP - The federal government will crack down on employers who use
illegal workers under new laws that take effect from tomorrow.
Under the laws it will be a criminal offence to employ a person who is either illegally
in Australia or is working in breach of their visa conditions.
The new laws will apply to any person or company that employs or refers illegal workers to work.
Minster for Immigration and Citizenship Kevin Andrews said people convicted will face
fines of up to $13,200 and two years' imprisonment and companies will face fines of up
to $66,000 per illegal worker with higher penalties for cases of exploitation, such as
slavery, forced labour or sexual servitude.
"The Coalition government is committed to helping Australian employers find eligible
and legal workers from overseas," Mr Andrews said in a statement today.
"However, this commitment comes with an obligation to enforce our laws where we detect
abuse of immigration arrangements."

Qld: Alleged armed robber to be extradited to Sydney
A man will be extradited from Queensland to New South Wales today .. accused of committing
a string of armed robberies in Sydney .. and firing shots at officers.
SOUBHI ARJA appeared briefly in the Brisbane Magistrates Court after his arrest on
the Gold Coast on the weekend.
It's alleged he committed a crime spree around Sydney's suburbs between March 7 and
8 .. robbing a hotel .. convenience store and service station.
Police allege ARJA fired shots at them during a chase .. until they were forced to
call off the pursuit.
He's been charged with several offences .. including armed robbery and aggravated robbery.
Two NSW police officers will escort him to Sydney today .. and he's expected to appear
in Downing Centre Local Court on Thursday.

Mr Duggan said Warne wound down his car window to say hello to the group in the taxi
and they began to abuse him and throw lollies.
"He (Warne) told the defendant to get rid of them, get them out of the cab," he said.
Shahi did not apply for bail.
Magistrate Charlie Rozencwajg remanded Shahi in custody to reappear in the same court
on August 28.
Warne is in England to captain Hampshire.
The star spin-bowler, who is closing in on 700 Test wickets, will spearhead Australia's
bid to reclaim the Ashes later this year.
